In U.S. v. KENNETH LOUIS DAVIS, 2021 WL 1651226, at *3 (E.D. Va. Apr. 27, 2021) (Brinkema, J.), in addition to reducing petitioner’s 762-month 924(c) stacked sentence to time-served (i.e., 233 months), the court finds community increase in COVID a harbinger of rising prison infections. "Although the BOP does not currently report any active cases of Covid-19 among the inmates at Coleman II, there are four staff members who are currently positive for the virus, which is particularly concerning given widespread resistance to Covid-19 vaccination efforts among prison staff5 and the rising rate of new hospital admissions for Covid cases in the county where the facility is located.”
Death Watch: The BOP has identified one new inmate fatalities, bringing the inmate death toll to 234. Five of these inmates died while on home confinement. Staff fatalities remain at 4.
